AGREEMENT ON PARTICIPATION IN A TOURIST EVENT
RALLY GRAVEL 2026

Parties

1. Organizer: RALLY TRAVEL sp. z o.o., ul. Prymasa Stefana Wyszyńskiego 85, 41-940 Piekary Śląskie, Poland, NIP: 4980279762, KRS: 0001184730, REGON: 542268361, e-mail: office@rally.travel, entry in the Register of Tourist Event Organizers: 1898; guarantee/insurance against insolvency: UNIQA Towarzystwo Ubezpieczeń S.A. under number: 3451639136.

2. Participant or participants: The person or persons indicated in the purchase form, making the purchase and accepting this Agreement.

3. Due to the fact that the Agreement concerns services related to leisure/recreation provided on a specified day or period, the Agreement concluded at a distance (online) is not subject to the 14-day right of withdrawal provided for certain consumer agreements. This provision does not limit the Participant's other rights under the Act on Tourist Events.

§1. Subject of the Agreement and nature of the event

1. The subject of the Agreement is the Participant's participation in an adventure-style motor and tourist expedition (self-drive/off-road) under the name “Rally Gravel 2026” (“Event”), organized within the territory of Poland.

2. The Event takes place on 3-5.07.2026 and takes the form of a three-day off-road expedition with one hotel base. The place of commencement and completion of the Event is a hotel located within the Opole Voivodeship or neighboring voivodeships, where the overnight stay is provided.

4. The program may be changed under the rules set out in §9.

5. The Event includes driving over varied terrain, in particular on gravel, forest, dirt and local access roads, in changing terrain and weather conditions.

6. The Participant drives the vehicle independently, at their own discretion, at their own risk and responsibility; the Organizer does not exercise ongoing or any other supervision over driving technique and does not provide driving instruction; however, the Organizer provides organizational coordination of the Event in accordance with §2.

7. Participants may complete the route individually or in smaller groups formed independently by the participants or organizationally during the Event. There is no obligation to travel in one convoy or for all participants to travel together along the entire route.

8. The Organizer and persons acting on its behalf do not provide the constant presence of a guide, pilot or caretaker with each participant or group of participants. The nature of the Event assumes independent navigation using the materials provided, in particular GPX tracks, while maintaining the possibility of organizational contact with the Organizer.

9. The Participant acknowledges that the pace of travel, group composition and the manner of completing individual sections may differ between participants depending on experience, preferences and conditions on the route.

10. The Participant acknowledges and fully accepts that due to the off-road nature of the Event, there is a high risk of damage, scratching, or even total destruction of the vehicle and equipment belonging to the Participant. The Participant assumes full and exclusive responsibility for the technical condition of their equipment and the manner and style of driving.

11. The Organizer shall not be liable for any material damage to the Participant's vehicle or property occurring during the route, including damage resulting from difficult terrain conditions, natural obstacles or force majeure events.

12. The expedition is intended for persons who are able to independently and safely drive the vehicle in which they participate in the Event. The Participant declares that their skills and experience are sufficient to take part in a recreational off-road motor expedition.

13. The Participant knowingly accepts all risks associated with the Event, including the risk of injury, permanent disability, or even death.

14. The Participant independently makes decisions regarding the manner of completing the route, the choice of driving pace and the assessment of the passability of individual sections.

15. The expedition route, maps and GPX tracks are prepared on the basis of available topographic, cartographic and local terrain information and may contain inaccuracies, temporarily impassable sections or sections requiring a detour.

16. The Participant acknowledges that the legal status of roads and areas may change at any time without notice to the Organizer.

17. The GPX file is for assistance purposes only. The Participant is obliged to verify signage in the field each time and comply with access prohibitions.

18. The Organizer shall not be liable for fines and penalties imposed on the Participant as a result of violating local traffic or nature protection regulations.

19. The Organizer shall not be liable for damage caused by other participants of the Event, third parties or other users of roads or areas.

20. The provisions of this Agreement concerning risk, the Participant's liability and the exclusion of the Organizer's liability refer in particular to risks arising from independent driving, the nature of off-road activity, the technical condition of the Participant's vehicle, decisions made by the Participant while driving and the actions of third parties. They do not exclude the Organizer's liability for proper performance of the tourist services covered by the Agreement to the extent required by mandatory provisions of law.

§2. Services included in the price:

1. The price of the Event includes:

A. logistical organization of the Event and coordination support throughout the route;

B. preparation of GPX tracks and organizational/navigation briefing before the start of the stages;

C. accommodation in accordance with the program, in a 3-5* hotel in the Opole Voivodeship or neighboring voivodeships;

D. accommodation in 2-person rooms;

E. 2 overnight stays;

F. 2 breakfasts at the hotel;

G. lunch on the track on Saturday;

H. 2 dinners – on Friday and Saturday;

I. the expedition program from Friday to Sunday in accordance with the schedule;

J. the TFG contribution (Tourist Guarantee Fund);

K. the TFP contribution (Tourist Assistance Fund);

L. care/support of the Rally Travel organizer throughout the trip.

2. The Event carried out on 3-5.07.2026 includes participation in the Event for 3 days and 2 overnight stays.

3. The price includes only the services expressly indicated in this paragraph. Any other services, including additional or optional services, remain outside the price of the Event unless otherwise expressly provided for in the Agreement or in an individual confirmation from the Organizer on a durable medium.

§3. Services not included in the price / Additional costs (borne by the Participant)

1. Everything not indicated in §2 above remains outside the price of the Event, in particular:

A. travel of the Participant and their vehicle to the hotel constituting the Event base in the Opole Voivodeship or neighboring voivodeships and return after the expedition;

B. fuel for vehicles and daily expenses on the route;

C. spare parts, consumables and any repairs or towing;

D. drinks with meals;

E. meals not listed in the program;

F. the Participant's personal expenses;

G. additional insurance covering high-risk sports;

H. supplement for a single room – determined individually;

I. rental of a vehicle or off-road equipment;

J. other costs not indicated in §2.

§4. Price, currency and exchange rates

1. The price of the Event is specified in EUR.

2. The regular price for 1 (one) Participant is 449 EUR. The deposit is 29% of the trip price. The first-minute price is 419 EUR until 2026-06-16. The price applies to the trip participant and is the same for drivers and passengers.

3. One price applies regardless of the type of vehicle: QUAD / UTV-SSV / MOTO.

4. The above price applies to the participation of 1 Participant in the Event.

5. Accommodation in a 2-person room is assumed.

6. The supplement for a single room is determined individually.

7. Public charges and supplier costs are settled according to the rates applicable on the date of charging.

8. The prices indicated in this paragraph do not include services not listed in §2, in particular vehicle rental and other costs indicated in §3.

9. In the event of a change in the commercial offer after publication of the booking form, the price indicated to the Participant at the time of placing the order and confirmed by the Organizer remains binding for the specific booking.

§5. Conclusion of the Agreement and payments

1. The reservation is made by completing the online form and paying a deposit amounting to 29% of the Event price, payable within 7 days from making the reservation.

2. The deposit constitutes part of the Event price and is settled under the rules set out in the Agreement and the provisions of the Act on Tourist Events.

3. Failure to pay the deposit within the above period results in automatic cancellation of the reservation, and the Agreement is deemed not concluded, without the need for any additional declarations by the Organizer.

4. Payment of the remaining balance of the full price shall be made no later than 16 days before the start of the Event.

5. Failure to pay the full price of the Event within the time limit indicated in paragraph 4 entitles the Organizer to terminate the Agreement due to the Participant's fault and cancel the reservation after a prior ineffective request to the Participant to pay within an additional period of not less than 3 days.

6. In such a case, the settlement rules for cancellation costs set out in §11 shall apply.

7. In the case of a reservation made 30 days before the start of the Event or later, payment of the full (100%) Event price is required.

8. The choice of vehicle type is made during the reservation process.

9. Payment may be made by bank transfer or payment card via the Stripe system.

10. A passenger may be added during the booking process on the website https://book.rally.travel/, in accordance with the Organizer's current offer.

§6. Participant's obligations (conditions of participation)

1. The Participant declares that they have sufficient off-road driving skills and all authorizations required to drive the vehicle in which they will participate in the Event, in accordance with the regulations applicable on the Event route.

2. The Participant shall provide protective equipment at their own expense (helmet, goggles, gloves, boots, armor, off-road clothing).

3. The Participant undertakes not to drive under the influence of alcohol or intoxicants; upon the Organizer's request, the Participant shall undergo a breathalyzer test.

4. The Participant shall ensure appropriate preparation and equipment of the vehicle and the gear necessary to participate in the Event, in particular:

A. driving license, identity document and vehicle documents;

B. a vehicle in full technical working order, after inspection/service, with current and functional consumable components;

C. a spare wheel and/or spare tire;

D. a tire repair kit and basic tools, including wrenches necessary to replace the belt in the given vehicle;

E. basic spare service parts, including spare drive belts (for UTV/QUAD – if applicable);

F. a fire extinguisher;

G. a personal first aid kit, headlamp and multitool;

H. clothing and protective equipment for changeable weather (approximately temperatures from 15°C to 30°C), including: helmet, goggles, gloves, protectors, an additional sweatshirt/fleece, a rainproof and windproof layer and appropriate footwear;

I. GPS navigation (recommended devices: Garmin Montana or Tread, if possible with InReach location sharing) or alternatively a navigation application (e.g. OsmAnd);

J. a запас of water and energy snacks for each day of driving, if the Participant has such a need;

K. a towing rope.

5. The Participant is responsible for having valid travel documents, vehicle documents, required authorizations, insurance and equipment required by the regulations applicable on the Event route.

6. The Participant shall comply with local law, park and facility regulations, environmental protection rules and safety instructions.

7. The Participant bears full responsibility for damage caused to the natural environment, infrastructure or property of third parties as a result of the manner of driving the vehicle.

§7. Safety and exclusion from driving

1. The Organizer may exclude the Participant from driving (while retaining the accommodation and catering services covered by the Agreement) in the event of:

A. appearing for driving or driving a vehicle while intoxicated or after consuming alcohol;

B. appearing for driving or driving a vehicle under the influence of intoxicants, psychoactive substances or other substances reducing psychophysical performance;

C. refusal to undergo a breathalyzer test or another test verifying sobriety/fitness, if the Organizer considers it justified by safety reasons;

D. lack of required protective equipment or refusal to use it, in particular: a helmet, goggles and other protective measures indicated in the Agreement;

E. gross violation of local law, safety rules or instructions of the Organizer issued to ensure safety;

F. lack of minimum vehicle control skills in terrain, if in the Organizer's opinion this creates a real threat to the safety of the Participant or other persons.

2. Exclusion from driving for reasons attributable to the Participant or justified by safety reasons does not constitute grounds for demanding a refund of the price for unused drives/off-road sections, provided that the remaining services are performed or remain available to the Participant in accordance with the Agreement and applicable law.

3. The Organizer may order the interruption of driving, omission of a section of the route or termination of participation in the off-road drive if required by safety, terrain conditions or the technical condition of the vehicle.

4. Breakdown, damage or immobilization of the Participant's vehicle does not constitute grounds for demanding a refund of all or part of the Event price, provided that the Organizer performs the remaining services covered by the Agreement.

5. The Organizer is not obliged to provide a replacement vehicle, service, parts or technical transport unless expressly agreed otherwise.

§8. Vehicle transport and logistics

1. The basic participation option in the Event assumes that the Participant reaches the hotel constituting the place of commencement of the Event, located in the Opole Voivodeship or neighboring voivodeships, on their own, and likewise organizes their return after the Event on their own.

2. Additional logistical services, in particular:

A. rental of an off-road vehicle;

B. other additional logistical solutions related to the delivery of equipment or the Participant's participation in the Event,

do not constitute part of the basic Event covered by the price. The Organizer may assist the Participant in renting a quad, UTV/SSV from trusted partners, however the conclusion of such a service takes place separately.

§9. Changes to the program and route

1. Terrain and weather conditions, safety considerations, decisions of authorities or circumstances beyond the Organizer's control may require changes to the route, the order of program points, driving times or the standard of accommodation.

2. The map and tracks are for illustrative purposes only. The final route may change.

3. There is no guarantee of passability of all sections or of a “constant pace” of driving.

4. Daily distances indicated in the offer materials are approximate.

5. The Organizer shall not be liable for non-performance or improper performance of services caused by force majeure, in particular natural disasters, fires, actions of authorities, border closures, armed conflicts, epidemics, strikes, infrastructure failures or sudden administrative prohibitions.

6. The above does not limit the Participant's rights under mandatory provisions of law, in particular in the event of a significant change in the main characteristics of the Event or its cancellation.

7. The Event program is a framework program and includes in particular:

I. Day 1 | Friday 03.07.2026 – gathering at the hotel in the Opole Voivodeship or neighboring voivodeships, organizational briefing, afternoon/evening off-road drive and dinner;

II. Day 2 | Saturday 04.07.2026 – breakfast at the hotel, all-day drive, among others, in the area of the Opole Voivodeship or neighboring voivodeships, lunch on the track, return to the hotel and dinner;

III. Day 3 | Sunday 05.07.2026 – breakfast, off-road drive and end of the expedition.

§10. Insurance and assistance

1. The Organizer does not provide, within the price of the Event, insurance covering high-risk sports.

2. The Participant is obliged to independently purchase additional insurance policy extended to risks associated with off-road driving, motor sports and rescue operations in the field. In the event of failure to have such a policy, the Participant acknowledges that all costs of rescue, medical transport and treatment resulting from practicing high-risk sports shall be borne by them directly and in full.

3. The Organizer reserves the right to verify that the Participant has an extended policy before the start of the Event.

4. The Organizer may enable the Participant to use a partner offer to extend insurance, however the conclusion of such an agreement takes place separately.

5. The Organizer shall provide appropriate assistance to the Participant who finds themselves in a difficult situation, within the limits of actual possibilities.

§11. Price change, minimum group, cancellations and transfers

1. Price changes are possible only due to: fuel/transport energy costs, taxes/fees, exchange rates – and no later than 20 days before the start of the Event.

2. In the event of a price change, the Organizer shall inform the Participant on a durable medium together with justification. The Participant is entitled to the rights provided for in the Act on Tourist Events.

3. Minimum number of participants: 10 persons and 10 vehicles. If the threshold is not met, the Organizer may cancel the Event, informing the Participant sufficiently in advance in accordance with the Act.

4. The Participant may cancel participation in the Event before its commencement at any time, subject to the obligation to pay a justified cancellation fee corresponding to the expected costs incurred by the Organizer:

A. 60 days or more before the start of the Event – 15% of the Event price;

B. from 59 to 35 days before the start of the Event – 35% of the Event price;

C. from 34 to 21 days before the start of the Event – 65% of the Event price;

D. from 20 to 8 days before the start of the Event – 85% of the Event price;

E. 7 days or less before the start of the Event – 100% of the Event price.

5. Deductions correspond to the expected costs incurred by the Organizer in connection with the preparation and implementation of the Event; at the Participant's request, the Organizer shall provide justification for the calculation of the deduction to the extent required by law.

6. Transfer of the reservation to another person: no later than 7 days before the start; the Participant and the transferee are jointly and severally liable for the price and justified transfer costs.

§12. Complaints and remedying non-conformities

1. The Participant shall immediately report any non-conformities found to the caretaker and by e-mail to office@rally.travel.

2. Complaints are handled without delay, no later than within 30 calendar days from their delivery on a durable medium.

§13. Personal data and image

1. The controller of the participant's personal data is the Organizer; the data are processed for the purpose of performing the Agreement and the Organizer's legitimate interests.

2. The Participant consents to the recording and use of their image and the image of the vehicle in multimedia materials created during the event (websites, social media, promotional materials), territory: worldwide; time: 5 years.

3. Consent may be withdrawn by e-mail to: office@rally.travel stating the name of the event.

4. Consent to use the image for marketing purposes is voluntary and does not constitute a condition of participation in the Event; lack of consent/withdrawal of consent does not affect the possibility of performing the Agreement.

§14. Governing law and court

1. The governing law is Polish law. Disputes shall be resolved by the ordinary courts having jurisdiction under the provisions, with respect for applicable consumer protection.

PARTICIPANT'S DECLARATION

By accepting this Agreement when making the online reservation, the Participant confirms that:

1. They have read all provisions of the Agreement and fully understand them.

2. They accept the nature of the event and the associated risks.

3. They have the required experience and off-road driving skills.

4. They undertake to comply with all provisions of the Agreement.
