AGREEMENT FOR PARTICIPATION IN A PACKAGE TRAVEL EVENT

1. Organiser: RALLY TRAVEL sp. z o.o., ul. 2. Participant or Participants: the person or persons indicated in the booking form for whose benefit the booking is made, including the driver, passenger or accompanying person. The person making the booking confirms that they are authorised to provide the data of the other Participants and to make the booking on their behalf.
3. Conclusion of the Agreement online: The Agreement is concluded electronically in the Organiser’s booking system. Before making a booking, the customer has the opportunity to review with the offer, the Information Form, this Agreement, the prices of the individual variants and the booking summary. Acceptance of the Agreement takes place by ticking the required checkbox and performing the action leading to the submission of the booking. The Agreement is concluded at the moment when the person making the booking receives electronic confirmation from the Organiser that the booking has been accepted.
4. No 14-day right of withdrawal: Due to the fact that the Agreement concerns services related to leisure or recreation provided on a specified date or during a specified period, an Agreement concluded at a distance is not subject to the 14-day right of withdrawal provided for certain consumer contracts. This does not limit the Participant’s rights arising from the Act on package travel and linked travel services, including the right to terminate the Agreement before the start of the Event on the terms set out in §11.
§1. Subject Matter of the Agreement and Nature of the Event
1. The subject matter of the Agreement is the Participant’s participation in an adventure-type automotive and tourism expedition (self-drive/off-road) named “Kashubia 2026” (the “Event”), organised in the territory of Poland.
2. The Event takes place on 09–11.10.2026 and is in the form of a three-day off-road expedition with one hotel base. The planned start is on 09.10.2026 at approximately 15:00, and the end on 11.10.2026 at approximately 15:00. The exact times are organisational in nature and will be confirmed before departure.
3. The place of commencement and termination of the Event is the hotel constituting the expedition base, located in the area of the Pomeranian Voivodeship or neighbouring voivodeships. Accommodation is provided in a hotel of at least 3* category, selected from among 3–5* establishments.
4. The programme and description of the trip are available on the offer page: https://rally.travel/en/kaszuby-2026. The information indicated in the confirmation of a specific booking, in particular concerning the number of Participants, their role, the type of vehicle, the price and payment deadlines, forms part of the Agreement.
5. The programme may be changed only on the terms set out in §9 and in mandatory provisions of law.
6. The planned total route distance is approximately 350–400 km. The distance, the length of individual stages and the course of the GPX tracks are approximate and depend, among other things, on current passability, signage, weather conditions, safety and decisions of the competent authorities.
7. The Event includes riding over varied terrain, in particular on gravel, forest, dirt and local access roads, in changing terrain and weather conditions. The route may include mud, sand, unevenness, ascents, forest tracks and other natural terrain obstacles.
8. The Event is not a sports competition, rally, race, speed trial, skill trial or any other form of competition between Participants.
9. The purpose of the Event is recreational and touristic completion of the made-available route, without time measurement, keeping rankings, determining the order of Participants or rewarding riding speed. The stated start and end times or approximate travel times are solely organisational in nature and may not be treated as an obligation to complete the route within a specified time.
10. The route of the Event is not closed, segregated or secured for the purposes of the Participants’ passage. The Organiser does not ensure that roads or areas are closed to traffic, the presence of security services at intersections and on individual sections, or the removal from the route of third parties, other vehicles, machinery or animals.
11. The Participant acknowledges that at any time the route may in particular contain: pedestrians, cyclists, residents, tourists, other road users, vehicles travelling in the same or opposite direction, agricultural and forestry vehicles, working machinery, animals and other obstacles unrelated to the Event.
12. The Participant is obliged to move with particular caution, comply with applicable regulations, signage and instructions of authorised persons, and adapt speed and riding manner to visibility, terrain and weather conditions, their own skills and the possibility of safely stopping the vehicle before any possible obstacle. The Participant may not assume that the route is free from third-party traffic or has been secured by the Organiser.
13. The Participant drives the vehicle independently, according to their own decision and at their own responsibility for the technique and manner of riding. The Organiser does not exercise ongoing supervision over riding technique and does not provide vehicle driving instruction; however, it provides organisational coordination of the Event in accordance with §2.
14. Participants may complete the route individually or in smaller groups formed independently or organisationally during the Event. There is no obligation to travel in one column or for all Participants to travel the entire route together.
15. The Organiser and persons acting on its behalf do not ensure the constant presence of a guide, tour leader or supervisor with each Participant or group. The nature of the Event assumes independent navigation using the materials made available, in particular GPX tracks, while maintaining the possibility of organisational contact with the Organiser.
16. The Participant acknowledges that the pace of travel, the composition of groups and the manner of completing individual sections may differ between Participants depending on experience, preferences and conditions prevailing on the route.
17. The Participant acknowledges that the off-road nature of the Event involves an increased risk of damage, scratching, breakdown, or even total destruction of the vehicle and equipment belonging to the Participant. The Participant is responsible for the technical condition of their vehicle and equipment, and for the manner and style of riding.
18. The Organiser shall not be liable for damage to the Participant’s vehicle or other property resulting solely from the characteristics of the terrain, natural obstacles, the technical condition of the vehicle, the Participant’s decision, the manner of driving the vehicle or the acts of third parties, unless the damage results from non-performance or improper performance by the Organiser of the travel services covered by the Agreement or from another circumstance for which the Organiser is liable under mandatory provisions of law.
19. The expedition is intended for persons having the ability to drive independently and safely the vehicle with which they participate in the Event. The Participant declares that their skills and experience are sufficient for participation in a recreational off-road automotive expedition.
20. The Participant knowingly accepts the typical risks associated with off-road activity, including the risk of accident, personal injury, permanent disability or death. Confirmation of awareness of risk does not constitute a waiver of the rights vested in the Participant against the Organiser under mandatory provisions of law.
21. The Participant independently makes decisions concerning the manner of completing the route, the choice of riding pace and the assessment of the passability of individual sections. If the Participant considers a section to exceed their skills, the vehicle’s capabilities or the accepted level of risk, they should stop riding or choose a safe detour.
22. The route, maps and GPX tracks are prepared on the basis of available topographic and cartographic data and local terrain information and may contain inaccuracies, sections temporarily impassable or requiring a detour.
23. The Participant acknowledges that the legal status of roads and areas may change without prior notice to the Organiser.
24. The GPX file is auxiliary in nature. The Participant is obliged in each case to verify signage in the field, comply with entry prohibitions and the applicable traffic and nature protection regulations.
25. The Organiser shall not be liable for fines and penalties imposed on the Participant as a result of their violation of traffic regulations, nature protection rules, area regulations or other applicable rules.
26. The Organiser shall not be liable for damage caused to the Participant by other Participants, third parties or other users of roads or areas, unless the Organiser’s liability follows from mandatory provisions of law.
27. The exact name and address of the hotel, the final GPX tracks and detailed organisational information are not published publicly. They will be provided to Participants before the start of the Event, in particular: by e-mail or in a file capable of being saved or in a closed group or communicator.
28. The planned group size is up to 25 Participants. This information is approximate in nature and does not limit the Organiser’s right to carry out the Event with a smaller number of persons, subject to the minimum number indicated in §11.
29. Organisational service and briefings are conducted in Polish. In the case of participation by foreigners, the Organiser may also provide organisational information in English. Participation does not require knowledge of any other foreign language.
30. Due to the off-road nature of the Event, the need to drive the vehicle independently, uneven surfaces, terrain obstacles and the lack of a guarantee of full accessibility of hotels and points on the route, the Event is, as a rule, not adapted to the needs of persons with reduced mobility. The Organiser does not guarantee the possibility of adapting the Event to individual needs. A person requiring special facilities should communicate their scope before making a booking; the Organiser will verify the possibility of taking them into account and may inform that adaptation is not possible.
31. The provisions concerning risk, the Participant’s responsibility and limitations of the Organiser’s liability relate in particular to risks arising from independent driving of the vehicle, the off-road nature, the technical condition of the vehicle, decisions made during riding and the acts of third parties. They do not exclude or limit the Organiser’s liability for proper performance of the travel services covered by the Agreement to the extent required by law.
§2. Services Included in the Price
1. The price of the selected Event variant includes the following services:
A. logistical organisation of the Event and coordination support on the entire route;
B. preparation of GPX tracks and an organisational and navigation briefing before the start of the stages;
C. accommodation in accordance with the programme in a hotel of at least 3* category, selected from among 3–5* establishments, in the territory of the Pomeranian Voivodeship or neighbouring voivodeships;
D. accommodation in double rooms;
E. 2 overnight stays;
F. 2 breakfasts at the hotel;
G. 1 lunch on the route on Saturday;
H. 2 dinners – on Friday and Saturday;
I. the expedition programme from Friday to Sunday in accordance with the outline schedule;
J. the contribution to the Tourism Guarantee Fund (TFG);
K. the contribution to the Tourism Assistance Fund (TFP);
L. organisational care by Rally Travel throughout the trip, understood as coordination and the possibility of organisational contact; this does not mean the constant presence of a guide, tour leader or supervisor with each Participant.
2. The Event includes participation for 3 days and 2 overnight stays on 09–11.10.2026.
3. Organisational and navigation briefings and some meals are planned as group services. Breakfasts are available within the time range specified by the hotel, usually around 7:00–9:00, and Participants do not have to consume them simultaneously. Lunch and dinners may be provided jointly or within the time range indicated by the Organiser or the establishment.
4. The price includes only the services expressly indicated in this paragraph, the booking confirmation or an individual arrangement communicated on a durable medium.
§3. Services Not Included in the Price and Additional Costs
1. Everything not indicated in §2 as services included in the price remains outside the price of the Event, in particular:
A. the Participant’s and their vehicle’s travel to the hotel constituting the Event base and the return after its completion;
B. fuel for vehicles;
C. supplies of water and snacks for the route;
D. the costs of repairs, servicing, parts, consumables and towing or transport of the vehicle;
E. costs resulting from breakdown, damage, immobilisation or loss of the Participant’s vehicle;
F. meals not listed in the programme;
G. beverages with meals;
H. tips, alcohol, souvenirs, medicines and personal expenses;
I. additional services, including, for example, massages;
J. entrance tickets, attractions and other optional fees, if not expressly indicated as included in the price;
K. insurance against cancellation costs, accidental consequences, medical treatment costs, rescue and medical transport, as well as additional insurance covering off-road driving, high-risk sports or motor sports;
L. the supplement for a single room – determined individually upon request and provided before ordering this service;
M. rental of a vehicle or off-road equipment;
N. other services and costs not expressly indicated as included in the price of the Event.
2. The Participant is not charged additional mandatory fees of which they were not informed before the conclusion of the Agreement. Optional services are ordered separately, and their price is provided before purchase.
§4. Price, Price Variants and Settlements
1. The price of the Event is specified in EUR and is a gross price per Participant.
2. The regular price is 449 EUR per Participant.
3. The promotional First Minute price is 429 EUR per Participant and – according to the offer applicable on the date of preparation of this Agreement. The period of validity of the promotion is indicated in the booking system. The period presented to the customer directly before making the booking is binding.
4. The price is the same for the driver, passenger and accompanying person and is independent of the selected type of vehicle: QUAD, UTV/SSV or MOTO, unless expressly indicated otherwise in the summary of the specific booking.
5. The exact price of the selected variant, visible in the booking system directly before making the booking and confirmed in the electronic confirmation of its acceptance, is binding for a specific Participant. A later commencement, termination or change of a promotion does not affect the price of an already concluded Agreement, unless the Organiser decides otherwise for the benefit of the Participant.
6. For a booking for one Participant, the deposit is 140 EUR at the regular price of 449 EUR or 130 EUR at the promotional price of 429 EUR. The deposit for the entire booking is calculated as 29% of its total price and rounded up to the next whole 10 EUR. The exact amount of the deposit for a specific booking is indicated in the order summary and booking confirmation. The deposit is credited in full towards the price.
7. The price has been calculated on the assumption of accommodation in a double room. The supplement for a single room is determined individually and requires confirmation of availability and price before it is ordered.
8. The total gross price includes all taxes and public-law charges due on the services included in the price, including the due contributions to TFG and TFP.
9. The Organiser settles the tourism service under the special VAT-margin scheme for travel agencies. On the invoice documenting the service covered by this scheme, the amount and rate of VAT are not shown separately.
10. After conclusion of the Agreement, the price of a specific booking is fixed and is not subject to increase by the Organiser. This does not limit the Organiser’s right to offer other prices for bookings concluded later or the right to grant the Participant an additional reduction.
11. The prices indicated in this paragraph do not include services not listed in §2, in particular vehicle rental and other costs indicated in §3.
12. In the event of a change in the commercial offer after publication of the booking form, the price indicated to the Participant at the time of placing the order and confirmed by the Organiser remains binding for the specific booking.
13. The Organiser reserves the right to periodically reduce the prices of the Event, introduce promotions, discounts, First Minute, Last Minute offers or other temporary price campaigns. The current price of the Event applicable at a given moment results from the Organiser’s current offer presented on the Event offer page and in the Organiser’s booking form / booking system.
14. The price binding for a specific booking is the price visible to the Participant in the booking form / booking system at the time of making the booking and confirmed by the Organiser after the booking has been made. A later introduction of a promotion, discount, price reduction or the end of a promotion does not affect the price of a booking already made and confirmed, unless the Organiser decides otherwise for the benefit of the Participant.
15. Periodic price reductions, promotions and discounts may be limited in time, quantity, variant or dependent on fulfilment of additional conditions indicated in the Organiser’s offer. Promotions may not be combined with other promotions, discounts or individual arrangements, unless the Organiser expressly decides otherwise.
§5. Conclusion of the Agreement Online and Payments
1. The booking is made in the Organiser’s online system by selecting the participation variant, indicating the Participant’s role, the type of vehicle, providing the required data, reviewing the documents, accepting the Agreement via the required checkbox, and using the button leading to payment or submission of the booking.
2. Directly before making the booking, the customer receives a summary including at least the number and roles of Participants, the selected type of vehicle, the unit price, the total price, the amount of the deposit or the amount payable, and the payment deadline.
3. The Agreement is concluded at the moment when the person making the booking receives electronic confirmation from the Organiser that the booking has been accepted. Mere display of the offer, commencement of completion of the form or transfer to the payment operator does not constitute conclusion of the Agreement if confirmation of acceptance of the booking has not been sent.
4. The data entered in the form, the choices made, the order summary, this Agreement, the Information Form and the electronic booking confirmation constitute the content of the arrangements concerning the specific booking. As regards the price, number and role of Participants, vehicle, payments and agreed special requirements, the confirmation of the specific booking takes precedence.
5. A handwritten signature or a qualified electronic signature is not required for conclusion of the Agreement. The system may record the date and time of acceptance, the booking identifier, the version of the document and other data necessary to demonstrate the course of the booking process.
6. At the time of conclusion of the Agreement or immediately after its conclusion, the Organiser provides the person making the booking, on a durable medium, in particular by e-mail or in a PDF file, with a copy of the Agreement or confirmation of its conclusion. The confirmation should indicate the data of the specific booking, the current data of the financial security, the person or contact point responsible for the course of the Event, and the agreed special requirements, if any.
7. The deposit is payable within 7 days from making the booking, unless the booking summary and confirmation indicate a shorter deadline resulting from the proximity of the commencement of the Event.
8. Failure to pay the required amount on time does not automatically result in the Agreement being deemed never to have been concluded. The Organiser may call upon the Participant to make payment, setting an additional deadline of not less than 3 days, and after its ineffective expiry terminate the Agreement and cancel the booking. In such a case, the appropriate and justified costs of termination of the Agreement specified in §11 may apply.
9. The remaining part of the price is payable no later than 16 days before commencement of the Event.
10. In the case of a booking made 30 days before commencement of the Event or later, payment of 100% of the price is required, unless the Organiser expressly permits a different schedule in the booking summary.
11. Payments may be made by fast bank transfer or payment card via the Stripe system, or by traditional bank transfer. Payments are not accepted in cash or into a travel escrow account.
12. A passenger or accompanying person may be added in the booking process in accordance with the current capabilities of the system and the offer. Each added person is a Participant in the Event and is subject to the provisions of the Agreement.
§6. Participant’s Obligations and Conditions of Participation
1. The Participant declares that they possess sufficient off-road riding skills and all authorisations required to drive the vehicle with which they will participate in the Event, in accordance with the regulations applicable on the route.
2. The Participant shall provide, at their own expense, appropriate protective equipment, in particular a helmet, goggles, gloves, protectors or armour, off-road clothing and appropriate footwear.
3. The Participant undertakes not to drive a vehicle under the influence of alcohol, narcotic drugs, psychoactive substances or medicines to a degree reducing the ability to drive safely. At the Organiser’s justified request, the Participant shall submit to a breathalyser test.
4. The Participant shall ensure proper preparation and equipment of the vehicle and the gear necessary for participation in the Event, in particular:
A. a valid identity document, the appropriate driving licence, vehicle documents and the vehicle insurance required by law;
B. a vehicle in full working order, registered, after inspection or servicing and with current consumable components;
C. a spare wheel or spare tyre;
D. a tyre repair kit and basic tools, including tools necessary to replace the belt in the given vehicle;
E. basic spare service parts, including spare drive belts for UTV/QUAD, if applicable;
F. a fire extinguisher;
G. a personal first-aid kit, headlamp and multitool;
H. clothing and equipment for variable weather, appropriate for cool October mornings and evenings, including an additional sweatshirt or fleece and a rainproof and windproof layer, additional gloves, additional shoes;
I. an intercom – not required, but recommended, as it facilitates communication on the route;
J. GPS navigation, e.g. Garmin Montana or Tread, where possible with InReach location sharing, or a navigation application, e.g. OsmAnd;
K. a supply of water and energy snacks for each day of riding, appropriate to their own needs;
L. a tow rope.
5. The Event is carried out in the territory of Poland. Polish citizens do not need a passport or visa. The Participant is obliged to possess the documents indicated above and meet the requirements concerning the vehicle driven.
6. As of the date of publication of the Agreement, the Organiser does not establish additional sanitary requirements or mandatory vaccinations connected with participation in this domestic Event. The Participant shall comply with the regulations and recommendations of the competent authorities applicable during the Event.
7. Participation requires a state of health and psychophysical fitness allowing independent and safe driving of a vehicle in terrain for several hours a day. The Participant should independently assess the possibility of participation and, in the event of illness, mobility limitations, taking medicines affecting driving or other health doubts – consult participation with a doctor.
8. The Participant shall comply with the law, the regulations of establishments and areas, environmental protection rules and the Organiser’s justified instructions issued in order to ensure safety or proper organisation of the Event.
9. The Participant shall be liable for damage caused to the environment, infrastructure, property of the Organiser or third parties as a result of their culpable act or manner of driving the vehicle.
10. A Participant requiring special services, facilities or adaptations is obliged to report them before making the booking. The Organiser will confirm on a durable medium whether the given requirement can be accepted for performance.
§7. Safety and Exclusion from Riding
1. The Organiser may exclude a Participant from riding, while retaining the accommodation and catering services covered by the Agreement, in the event of:
A. reporting for riding or driving a vehicle while intoxicated or after alcohol consumption;
B. reporting for riding or driving a vehicle under the influence of narcotic drugs, psychoactive substances or other substances reducing psychophysical fitness;
C. refusal to submit to a justified breathalyser test or other lawful test verifying sobriety or fitness;
D. lack of the required protective equipment or refusal to use it;
E. gross violation of regulations, safety rules, environmental protection rules or the Organiser’s justified instructions;
F. lack of minimum skills in driving a vehicle in terrain, if this creates a real danger to the Participant or other persons;
G. a finding of the technical condition of the vehicle that creates a real danger to the Participant, other persons or the environment.
2. Exclusion from riding for reasons attributable to the Participant or justified by safety considerations does not constitute grounds for demanding a refund of the price for unused rides or off-road sections, provided that the remaining services are performed or remain at the Participant’s disposal in accordance with the Agreement and the law.
3. The Organiser may order interruption of the ride, omission of a section of the route or termination of participation in the off-road ride, if required by safety, terrain conditions, the Participant’s state of health or the technical condition of the vehicle.
4. Breakdown, damage or immobilisation of the Participant’s vehicle, for which the Organiser is not liable, does not constitute grounds for demanding a refund of all or part of the price of the Event, provided that the Organiser performs the remaining services covered by the Agreement.
5. The Organiser is not obliged to provide a replacement vehicle, servicing, parts or technical transport, unless otherwise expressly agreed on a durable medium.
§8. Vehicle Transport and Logistics
1. The price of the Event does not include organised transport of the Participant or their vehicle to the place of commencement of the Event or from the place of its termination. The Participant reaches and returns from the hotel constituting the Event base in the area of the Pomeranian Voivodeship or neighbouring voivodeships at their own expense and by their own means.
2. Travel on the route takes place in the Participant’s own vehicle or a vehicle rented by them separately. The Participant drives the vehicle independently in the self-drive formula.
3. Additional logistical services, in particular rental of an off-road vehicle, delivery of equipment or other transport solutions, do not constitute an element of the basic Event covered by the price, unless they have been expressly added to the specific booking.
4. The Organiser may assist the Participant in establishing contact with an entity offering quad or UTV/SSV rental; however, the rental agreement is concluded separately, and the parties’ liability follows from the terms of that agreement.
§9. Changes to the Programme, Route and Services
1. Terrain and weather conditions, signage, passability, safety considerations, decisions of the authorities or other circumstances beyond the Organiser’s control may require a change in the course of the route, the order of programme points, the times of travel or the place of performance of individual services.
2. The map and tracks are illustrative and auxiliary in nature. The final course of the route may change before or during the Event.
3. The Organiser does not guarantee passability of all planned sections or maintenance of a constant riding pace.
4. Daily distances and the planned total distance of 350–400 km are approximate in nature.
5. A change of hotel is possible while maintaining at least the declared minimum 3* standard, unless the Participant accepts another solution or the provisions concerning change of the terms of the Agreement apply.
6. In the event of unavoidable and extraordinary circumstances, the rights and obligations of the Organiser and the Participant are determined by the provisions of the Act on package travel and linked travel services. The Organiser shall take the actions required by the provisions, in particular provide the Participant with appropriate assistance and, in cases provided for by law, remedy non-conformities or provide appropriate substitute services.
7. The Organiser is not obliged to pay damages or compensation for non-conformity if it proves that it was caused by:
A. an act or omission of the Participant;
B. an act of a third party unconnected with the performance of the travel services covered by the Agreement, which could not have been foreseen or avoided;
C. unavoidable and extraordinary circumstances, including, among others: natural disasters, fires, actions of the authorities, closure of borders, armed conflicts, epidemics, strikes, infrastructure failures or sudden administrative prohibitions, etc.
8. The programme of the Event is of an outline nature and includes in particular:
I. Day 1 – Friday, 09.10.2026: gathering at the hotel, organisational and navigation briefing, afternoon and evening off-road ride, return to the hotel and dinner;
II. Day 2 – Saturday, 10.10.2026: breakfast at the hotel, all-day off-road ride on the designated route, lunch on the route, return to the hotel and dinner;
III. Day 3 – Sunday, 11.10.2026: breakfast, off-road ride and end of the Event.
9. The exact name and address of the hotel, the final schedule and the GPX tracks will be provided to Participants before the commencement of the Event on a durable medium.
§10. Insurance, Assistance and Insolvency Protection
1. The price of the Event does not include insurance against cancellation costs, accidental consequences, medical treatment costs, rescue, medical transport or insurance extended to cover off-road driving, high-risk sports or motor sports.
2. The Participant is obliged to ensure the vehicle insurance required by law and independently purchase an appropriate personal insurance policy covering the actual nature of the activity, including off-road driving, motor sports, rescue actions and medical transport. Cancellation cost insurance is voluntary and depends on the Participant’s decision.
3. Before the start, the Organiser may verify possession of the policy referred to above. The absence of the required policy may constitute grounds for refusing to permit the Participant to ride if its possession was indicated as a condition of participation.
4. The Organiser may enable use of a partner insurance offer for an additional fee. Conclusion of such an agreement takes place separately, and the scope of protection results from the insurance terms communicated before purchase.
5. The Organiser shall provide appropriate assistance to a Participant who has found themselves in a difficult situation, within the scope and on the terms provided for by the Act and within the limits of actual possibilities.

8. The Organiser maintains continuity of the financial security required by law. In the confirmation of a specific booking and in the confirmation provided after receipt of payment, the Organiser indicates the security appropriate for the given Agreement and the manner of pursuing claims. If, after conclusion of the Agreement, a further security covering the period of performance of the Event is issued, its details will be provided to the Participant on a durable medium.

10. The details of the person representing the Organiser or the contact point responsible for the course of the Event, including the telephone number for contact during the trip, will be indicated in the electronic confirmation of conclusion of the Agreement or provided to the Participant on a durable medium before commencement of the Event.
§11. Minimum Number of Participants, Cancellation and Transfer of the Agreement
1. A price change is possible solely due to: transport fuel/power source costs, taxes/charges, exchange rates – and no later than 20 days before commencement of the Event.
2. In the event of a price change, the Organiser shall inform the Participant on a durable medium together with justification. The Participant is entitled to the rights provided for in the Act on package travel.
3. The minimum number required for implementation of the Event is 10 persons and 10 vehicles.
4. If the number of entries is lower than required, the Organiser may terminate the Agreement and cancel the Event, informing the Participant on a durable medium no later than 7 days before commencement of the Event. The Organiser shall refund the payments received no later than within 14 days from termination of the Agreement.
5. The Participant may terminate the Agreement at any time before commencement of the Event. Subject to cases of statutory termination of the Agreement without a fee, the following standard cancellation fees apply:

6. The fees correspond to the Organiser’s anticipated costs, taking into account expected savings and the possibility of alternative use of the services. If the actual appropriate and justified fee is lower than the standard fee, the Organiser shall apply the lower amount. At the Participant’s request, the Organiser shall present justification of the amount of the fee.
7. The Participant may terminate the Agreement before commencement of the Event without a fee in the event of unavoidable and extraordinary circumstances occurring at the destination or in its immediate vicinity, which significantly affect the performance of the Event or transport to the destination, on the terms specified in the Act.
8. The Participant may transfer all rights vested in them under the Agreement to a person meeting the conditions of participation if they notify the Organiser on a durable medium. Notification made no later than 7 days before commencement of the Event is deemed to have been made within a reasonable time.
9. The Participant and the person taking over the rights are jointly and severally liable for the unpaid part of the price and the actual, justified and not exceeding the costs incurred by the Organiser costs of the transfer. The Organiser shall present proof of the incurred costs upon request.
§12. Non-Conformities, Complaints and Out-of-Court Dispute Resolution
1. The Participant shall promptly report non-conformities found during the Event to the person representing the Organiser or the contact point indicated in the booking confirmation, and may additionally report them by e-mail to office@rally.travel.
2. The Organiser shall remedy the non-conformity within a reasonable period set by the Participant, unless this is impossible or involves costs disproportionately high in relation to the scope of the non-conformity and the value of the services.
3. If a significant part of the services cannot be performed in accordance with the Agreement, the Organiser shall offer appropriate substitute services at no additional cost. The Participant is entitled to rights to a price reduction, damages, termination of the Agreement or other remedies provided for by the Act.
4. Complaints may be submitted on a durable medium, in particular by e-mail to office@rally.travel or in writing to the Organiser’s address. The Organiser shall respond to the complaint without delay, no later than within 30 calendar days of its receipt, unless special provisions require a shorter time limit.
5. A consumer may make use of out-of-court methods of handling consumer disputes, in particular with the assistance of the competent Voivodeship Inspectorate of the Trade Inspection or other entities entered in the register of authorised entities. Information is available on the website of the Office of Competition and Consumer Protection.
6. Use of the complaint procedure or out-of-court procedure does not exclude the right of either party to pursue claims before a court.
§13. Personal Data and Image
1. The controller of personal data is RALLY TRAVEL sp. z o.o. The data necessary for the conclusion and performance of the Agreement are processed for the purpose of taking steps at the request of the person making the booking, concluding and performing the Agreement, fulfilling legal obligations, and pursuing or defending claims, in accordance with the Privacy Policy made available in the booking system.
2. Processing of the data necessary for implementation of the booking and the Agreement does not require the Participant’s separate consent. Ticking the box confirming acceptance of the Agreement and acknowledgement of the Privacy Policy does not constitute consent to data processing that is necessary for the conclusion or performance of the Agreement.
3. By signing the agreement, the Participant consents to the recording and use of their image and the image of the vehicle in multimedia materials created during the event (websites, social media, promotional materials), territory: worldwide - time: 5 years.
4. Consent to the recording and use of the Participant’s or vehicle’s image for marketing purposes is voluntary and does not constitute a condition for conclusion of the Agreement or participation in the Event.
5. Consent may be withdrawn by e-mail to office@rally.travel stating the name of the event; withdrawal does not affect the lawfulness of use made before its withdrawal.
§14. Final Provisions and Electronic Acceptance
1. The governing law is Polish law. Disputes shall be resolved by the common courts having jurisdiction in accordance with the applicable provisions, with respect for the protection vested in the consumer.
2. This Agreement should be read together with the Information Form, the offer, the data entered in the form, the order summary and the electronic booking confirmation. In the event of a conflict concerning the individual parameters of a specific booking, the electronic confirmation takes precedence, provided that it does not limit the Participant’s rights arising from mandatory provisions of law.
3. In the event of a conflict between this Agreement concerning Kashubia 2026 and the provisions of the General Terms and Conditions, the provisions of this Agreement shall prevail as directly relating to this Event.
4. Acceptance of the Agreement takes place online. The absence of a handwritten signature on a printout does not affect the validity of the Agreement. The Organiser records the version of the Agreement accepted for the specific booking and provides it or confirmation of its conclusion on a durable medium.
5. By accepting the Agreement in the booking system, the person making the booking confirms that they have read its contents, the Information Form and the order summary, understand the nature of the Event and the typical risks associated with it; have provided truthful data and information regarding their experience and off-road riding skills; undertake to comply with all provisions of the Agreement and to provide the other Participants with the documents and information concerning the Event.
